General Terms and Conditions

1. Introduction

  1. Good.travel (“we”, “us”, “our”) is a hotel search Platform that helps Users (“you”) find, compare and book hotels that aim to make a positive societal and/or environmental impact. Hotels displayed on our website all claim to support a Good cause and give back to their local communities by, for example, donating a portion of each Booking to a local charity.

  2. Good.travel is operated by Good Travel Barcelona SL (VAT: B72901549), a legal entity with its registered office at Rambla de Cataluña, 73 1o, 08007 Barcelona, Spain. You can find additional information about our organisation and this Platform under https://good.travel/terms on our website.

2. General Information

  1. These General Terms and Conditions govern your access to and use of our services and Platform. Please read these General Terms and Conditions carefully before you access and/or use our Platform or make use of any of our services.
  2. By using our Platform, you confirm that you have read, understood, and agree to be bound by these General Terms and Conditions, as well as our Privacy and Cookies Statements. You may not access and/or use our services or Platform if you disagree with these General Terms and Conditions.
  3. We reserve the right to change these General Terms and Conditions whenever we find necessary. We will publish a revised version of these General Terms and Conditions on our website. It is your responsibility to periodically check these General Terms and Conditions for changes, as these will also be applicable to you. Continuing to use our Platform means that you agree to the updated or amended General Terms and Conditions. In case you do not agree with any of these changes, you shall cease using our Platform.

3. Definitions

  1. The definitions used in these General Terms and Conditions, when capitalised, in the singular or plural form, shall have the following meaning:
  • ‘Accommodation’ means the provision of an accommodation (e.g. hotel, motel, apartment, bed & breakfast) service by an Accommodation Provider.
  • ‘Accommodation Provider’ means the professional provider of Accommodation (e.g. hotel, motel, apartment, bed & breakfast) made available on the Platform.
  • ‘Booking’ means the purchase, order, (facilitated) payment or reservation made using our Platform, whether paid for now or later.
  • ‘Intellectual Property Rights’ means all rights of intellectual property and related rights, such as copyrights, trademark rights, patent rights, design rights, trade name rights, database rights and neighbouring rights.
  • ‘Platform’ means the website or app with which you can book Accommodations whether owned and operated by Good.travel or the Accommodation Providers.
  • ‘Personal Data’ means any information relating to an identified or identifiable natural person as defined in article 4 of the General Data Protection Regulation (GDPR).

4. About our Platform and services

  1. Good.travel is a Platform on which hotels can promote available Accommodations. The hotels displayed on our Platform are hotels that we have a business relationship with, either directly or indirectly through an intermediary. Please note that We do not own any of these hotels ourselves. We merely give you the option to search for, compare, and book stays at these hotels.

5. Contractual relationships

  1. By booking an Accommodation through our Platform, you agree to be bound by these General Terms and Conditions, the terms and conditions of the Accommodation Providers and any other terms displayed during or before the booking process.
  2. When booking an Accommodation through our Platform, you do so directly with the Accommodation Provider. After completing your Booking, a contract is concluded between you and the Accommodation Provider. We are not a contractual party to this Booking. You may not assert any claim or commence any suit, action or proceeding against Good.travel for an Accommodation Provider’s failure to perform a contractual obligation.

6. Accommodation Providers

  1. While we take reasonable care when selecting Accommodation Providers, we cannot guarantee the accuracy of the information displayed on our Platform about their societal and/or environmental impact and/or their charitable contributions. This information is based on information shared with us by the Accommodation Provider and user feedback. It is the responsibility of the Accommodation Provider to ensure that the information displayed on our Platform is accurate and reliable. You are highly encouraged to inform us of any inaccurate information that you may notice on our Platform. In turn, we will do our best to rectify or remove such information entirely.
  2. The information that we provide on our Platform on Accommodations and services may deviate from the information on the website or Platform of the Accommodation Provider. The Accommodations and services of the Accommodation Provider displayed on our Platform are in no way exhaustive or indicative of all available Accommodations or services that the Accommodation Providers provide. It might very well be possible for the Accommodation Provider to offer additional Accommodations or deals.
  3. The information that we provide on our Platform about your Bookings is based on what the Accommodation Providers have shared with us. We cannot guarantee the accuracy, quality, completeness, reliability or credibility of this information. It is the responsibility of the Accommodation Provider to make sure that the information displayed on our Platform about your Booking is indeed accurate and up-to-date.

7. Prices

  1. By booking an Accommodation through our Platform, you agree to pay the costs for that Booking. This shall include any additional charges or taxes that may apply to your booking, but may exclude additional local taxes (e.g. city-taxes).
  2. All prices and rates shown are subject to programming, manifest and typing errors. Obvious pricing errors that may appear shall in no way be binding. In the event of such an error, Good.travel reserves the right to cancel any Booking made without being subject to any further liability.
  3. We do not update the prices that we receive from Accommodation Providers in real time. It is possible for the price that appears on the Booking website of the Accommodation Provider to not correspond with the prices displayed on our Platform. We are not liable nor responsible for any differences in prices.

8. Payment

  1. Good.travel organises your payments to the Accommodation Provider. When you book an Accommodation through our Platform, you authorise Good.travel to facilitate your payment arrangements with the Accommodation Providers. Good.travel only facilitates such payments and is at no time a party to these payments.
  2. To facilitate your payments, we may involve third-party payment service providers.
    You are responsible for providing us or the third-party payment service providers with accurate and updated payment method information. Good.travel assumes no liability or responsibility for your failure to provide such information.

9. Amendments, cancellations, and refund policies

  1. When you book an Accommodation through our Platform, you agree to be bound by all applicable policies shown during or before the Booking process, including the amendments, cancellation, no-show, damages and refunds policies of the Accommodation Provider.
  2. The cancellation, no-show and refund policy differs per Accommodation Provider. Such policies are specified on the Platform before or at the moment of Booking and may be included in the confirmation of your Booking. We recommend that you read the cancellation, payment and no-show policy of the Accommodation Providers carefully before completing your Booking.
  3. You are responsible for complying with any applicable cancellation, pre-payment and no-show policies. Good.travel does not accept any liability or responsibility for your non-compliance with the Accommodation Providers’ policies. Good.travel will charge you all cancelation charges it receives from the relevant Accommodation Provider.
  4. If you wish to amend or cancel your Booking and the amendments or cancellation policies of the Accommodation Provider allow you to do so, you shall get in touch with us as (timely/promptly) as possible and request that we amend or cancel your booking for you. You can reach us by phone or by email via the credentials available on our website and/or in this Policy. We generally prefer that you contact us by phone in case of last-minute amendments or cancellations, as this will allow us to carry out your request more quickly.
  5. If you are not satisfied with the booked Accommodation or the services provided by the Accommodation Provider and wish to bring this to the attention of the Accommodation Provider or request a refund, you shall get in touch with us promptly, but in case of a requested refund no later than 24 hours after you became aware of the situation that led to your claim, as this allows us to communicate this to the Accommodation Provider on your behalf.
  6. In case you have a late or delayed arrival on the check-in date or only arrive the next day, you must make sure to (timely/promptly) communicate this with the Accommodation Provider to avoid the cancellation of your Booking by the Accommodation Provider or to charge you a no-show fee. We do not assume any responsibility or liability for the consequences of delayed arrival or cancellation or charge of a no-show fee by the Accommodation Provider.
  7. You shall be aware that Accommodation Providers may deny check-in and not honour the Booking if you are under 18 years old and not accompanied by your parents or legal guardian. Good.travel assumes no liability or responsibility in such an event.
  8. If you complete a Booking which requires you to pay in advance, please note that the Accommodation Provider may cancel your Booking without notice if they are unable to collect the amount due. You are responsible for making sure that the payment of your Booking can proceed on time.

10. User obligations

  1. To be able to use our services you must be capable of entering into legally binding agreements. By making use of our services You guarantee that you will not use our service in any way or for any purpose that goes against our company values or violates any applicable law or regulations.
  2. When booking through our Platform, you must provide us with accurate contact details, so that we and/ or the Accommodation Providers can provide you with accurate information and contact you if necessary.
  3. You are responsible for obtaining the necessary documentation at destination, such as visas, identity documents, passports, etc. Good.travel will not be responsible for your failure to do so.
    As the person making the Booking You are responsible for the actions and behaviour of everyone in your group at your Accommodation. As the person making the Booking You are also responsible for obtaining the permission of everyone in your group before sharing their personal data with us.

11. User restrictions

  1. Good.travel reserves the right to restrict your ability to book Accommodations through our Platform, to cancel Bookings made through our Platform, and/or to stop you from accessing or using our Platform and services altogether. We may do so when we deem necessary and to the extent permitted by law, we are not required to provide you with prior notice.
    Situations where we may deem any of the restrictions referred to in this provision necessary include, among others:
  • The provision of incomplete or erroneous information;
  • Fraud or abuse;
  • Inappropriate or unlawful behaviour;
  • Failure to comply with these General Terms and Conditions, our company values, applicable laws and regulations, or the policies of Accommodation Providers.
  • If we cancel a Booking for reasons described in this provision, you will not be entitled to a refund. We may inform you of the reasons for cancelling your Booking except when doing so would contravene with applicable laws and/or prevent or obstruct an investigation into fraud or other illegal activities. In case you believe we have incorrectly restricted your access, you may contact our Customer service team.

12. Privacy and cookies

  1. The protection of your personal data is our highest priority. We will make sure that we comply with all applicable privacy and data protection laws and regulations.

13. Emails about special offers, promotions and future events.

  1. We intend to send you only e-mail communications that will be useful to you and that you want to receive. We may periodically contact you via e-mail and provide information about special offers and promotions that may be of interest to you.
  2. We use a third-party e-mail service provider to send e-mails. This service provider is prohibited from using your e-mail address for any purpose other than to send e-mails relating to our products and services.
  3. We may send you e-mail communications relating to the promotions of select, reputable third parties with whom we have a strategic marketing relationship because they offer products or services that we believe would be of interest to you. If you do not wish to receive any e-mails, you may opt-out of future emails by following the instructions provided in the e-mails.
  4. At your choice, you may use our Platform to opt-in to e-mail communications containing information of future events. We will not use any information provided in response to such communications for any unauthorised purposes.

14. Communication with Accommodation Providers.

  1. We may help you communicate with your Accomodation Provider, but we can’t guarantee that they will honour and/or consider incoming requests from you, or that they will do what you request. We bare no liability or responsibility for their failure or inability to perform as requested and/or required.
  2. Intellectual Property RightsUnless stated otherwise, the Intellectual Property Rights in all the materials, shared with you, our Platform and all the content distributed via the Platform, are exclusively vested in Good.travel and our licensors and affiliates.
  3. You acknowledge these rights and guarantee that you will refrain from any infringement hereof. This includes refraining from making copies of the Platform other than technical copies which may be required for you to be able to use our Website (loading and displaying).
    Unless we have provided you with our or our licensors’ written permission, you shall not monitor, copy, scrape or crawl, download, reproduce or use any content distributed via our Platform for any commercial purpose.
    Links to third party websites and third-party contentOur Platform contains hyperlinks to other websites maintained by third parties. Good.travel has no influence whatsoever on the information provided on these websites and accepts no liability for damages arising in any way from the use of these websites.
  4. We bear no responsibility for photographs, descriptions, other information material on the Platform and other (advertising) material published by third parties.

15. Liability

  1. Good.travel shall not be liable for any costs incurred as a result of your non-compliance with these General Terms and Conditions, the terms and policies of the Accommodation Providers or any other policies that may apply.
  2. Good.travel shall not be liable, except in the case of intent and gross negligence, for damages arising from loss, inaccuracy and/or incompleteness of information uploaded by our users and/or Accommodation Providers.
  3. Good.travel acts as an independent intermediary between you and the Accommodation Providers. At no time do We act as an organiser or a travel agency. The Terms and Conditions and policies of the Accommodation Providers apply exclusively when it comes to the cancellation or withdrawal of your Booking.
  4. We are not liable in the event of death, injury, illness, damages, loss, accident, theft, delay, disturbance or any other irregularity resulting directly or indirectly from the services provided by the Accommodation Providers.
  5. In the event that liability arises on Good.travel, such liability shall be limited to a maximum of cost of your Booking.

16. Contact and Online Dispute Resolution

  1. You may contact our Customer service Team at [email protected] if you have any questions, queries or complaints.
  2. Your satisfaction is our top priority. We urge you to contact us if you are not satisfied with our Customer Service or the way that we handled your complaint. If you remain unsatisfied, you may always complain via the European Commission’s ODR-Platform. The ODR-Platform is a platform established by the European Commission for the resolution of online disputes. You can access the ODR-Platform at ec.europa.eu/odr.

17. Waiver and Severability

  1. Our failure to enforce any provision of these Terms and Conditions shall not operate as or be construed as a waiver of our right to do so later.
    If any provision of these General Terms and Conditions cannot be invoked on the grounds of nullity, reasonableness and fairness or an unreasonably onerous nature, the other provisions of these General Terms and Conditions shall remain in full force and effect and, instead of the invalid provision, a provision shall apply that most closely approximates it.

18. Prevailing language

  1. These General Terms and Conditions were originally drawn up in English. In case there is any conflict, mismatch or inconsistency between the English version of these terms and a translated version, the English version shall prevail.

19. Specific terms prevail

  1. In case there is any conflict, mismatch or inconsistency between these General Terms and Conditions and any Specific terms that may apply, the specific terms shall prevail.

20. Applicable law and competent courts

  1. All legal relationships between you and Good.travel shall be governed by Dutch law with the exclusion of its conflict of law regime.
  2. Insofar as allowed by governing law, any disputes arising from these General Terms and Conditions shall be submitted exclusively to the competent court of Amsterdam, The Netherlands, unless we, as plaintiff or petitioner, opt for the competent court in your place of residence or registered office.
